In the meantime, I was listening to the 442.100 repeater tonight. It was playing the ARRL news. They were reporting about Pennsylvania passing PRB-1 laws. This makes Pennsylvania the 27th state to adopt this HAM friendly federal law. Listen to the mp3 HERE. For those who are involved in a struggle to exercise your rights here is a link to the PRB-1 ARRL information page. (http://www.arrl.org/FandES/field/regulations/PRB-1_Pkg/) And here is the link to the list of states that have adopted PRB-1 with the pertinent laws referenced. (http://www.arrl.org/FandES/field/regulations/statutes.html)

Yes, Florida has adopted PRB-1 (See State Statutes Chapters 125.561 and 166.0435) Additionally, the ARRL provides Volunteer Lawyers to help their members.  (see http://www.arrl.org/FandES/field/regulations/local/vci.html)

Just a little commentary:

Although some HAMs in my area believe that exercising your rights is not necessary (”after all it’s just radio”), I believe that if we do not protect the rights afforded to us, they will be taken away. It is not just radio, it is our rights, and I will fight to protect yours and mine.

Stay tuned John KI4WMI has done a lot of work and you will be able to see it soon.

From John Hayes KI4WMI

Mario KU5E,

Many people have asked questions about tower height laws.

This law is known as PRB-1 and gives a ham certain rights.

Although this law was created in 1985, we can see that Fl made it clear in 1991 by supporting the Federal law. This support and adopting the law inot it’s state laws t was to give HAMS certain rights.

In 1991 House Bill No 203 was created and gave HAMS certain rights as to tower heights. This Bill would later become law with out the governors signature.

Chapter 125 of the Fl statues deals with County Government.(fs 125.561)

Chapter 166 This chapter dealt with Municipalities. (fs 166.0435)

Both of the these statues incorporated the Federal Law dealing with Tower heights into FL law. Keep in mind that state law usually over rides County ordinances.
